1. About this agreement
This User Agreement ("Agreement") is between you and Payolla LLC, doing business as Speedy Money Transfer ("Speedy", "we", "us", "our"), 255 Davis Street, Miramar Beach, Florida 32459. It applies when you create a Speedy account or use our website, mobile app, WhatsApp channel or any other Speedy service (together, the "Services").
Money transmission services are provided by Partner legal name ("Partner"), NMLS ID Partner NMLS ID, a money transmitter licensed in the states listed on our Licenses and Regulatory Disclosures page. Speedy acts as agent / authorized delegate of Partner. For each transfer, Partner is the remittance transfer provider under federal law. By sending money you also agree to Partner's Partner user agreement title, available at Partner URL. If that agreement and this one conflict about the movement of your money, Partner's agreement controls unless this Agreement gives you greater rights.
Speedy is not a bank. Money you send through Speedy is not a deposit and is not insured by the Federal Deposit Insurance Corporation (FDIC).
This Agreement includes, by reference, the Remittance Transfer Rights, Fees and Exchange Rates, E-Sign Consent, Messaging Terms, AI Assistant Terms, Acceptable Use Policy and Privacy Notice.
Please read Section 22. It contains an agreement to resolve disputes by individual arbitration, a waiver of class actions and jury trials, and a way to opt out within 30 days.
2. Who can use Speedy
To open an account you must:
- be at least 18 years old (or the age of majority where you live, if higher);
- live in a U.S. state where Speedy offers the Services, as listed on the Licenses page;
- have a valid U.S. mobile number and email address that you control;
- give us true, current and complete information, and keep it up to date;
- use the account only for yourself, for personal, family or household purposes, and not on behalf of anyone else or a business.
You may have only one Speedy account. We may refuse to open an account, or limit the Services, if we cannot verify your identity or if the law or our risk policies require it.
3. Verifying your identity
Important information about procedures for opening a new account. To help the government fight the funding of terrorism and money laundering activities, federal law requires financial institutions to obtain, verify and record information that identifies each person who opens an account. When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
We use identity verification providers to check your government ID, a selfie or liveness check, and database records. We may ask for more information later, for example to raise your sending limits, after a change of device, or when the law requires it. If you don't provide it, we may limit, suspend or close your account.
4. Keeping your account secure
You are responsible for keeping your device, passkey, PIN and one-time codes secure. Do not share them with anyone, including people who say they work for Speedy. Speedy will never ask you to tell us a code, PIN or password by phone, text, email or chat.
Tell us immediately at support phone or support@speedymoneytransfer.com if you think someone else has accessed your account, your device is lost, or a transfer was sent without your permission. We will act quickly to protect your account. Your rights regarding errors and unauthorized transfers are explained in Section 9 and on the Remittance Transfer Rights page.
5. How a transfer works
- You enter the details. You choose the recipient, the amount, the destination country and the delivery method (bank deposit, mobile wallet or cash pickup, where available).
- You see a pre-payment disclosure. Before you pay, we show you the amount you send, our fees, any taxes we collect, the total you pay, the exchange rate, any fees and taxes imposed by others that we know of, the amount your recipient will receive, and the date the money will be available.
- You approve and pay. You approve with your passkey or other authentication we require.
- You get a receipt. We give you a receipt with the same information, the date of availability, your recipient's details, your cancellation and error rights, and contact details for us, our Partner's regulator and the Consumer Financial Protection Bureau.
The exchange rate shown in the pre-payment disclosure is the rate that applies once you pay. Your recipient may receive less than the amount shown because of fees charged by the recipient's bank or wallet provider and foreign taxes, which we will tell you about where required.
Recipient information. You must give accurate details for your recipient. For cash pickup, your recipient must show valid identification that matches the name you entered. If you give us an incorrect account number or institution identifier, you could lose the transfer amount; Section 9 and the Remittance Transfer Rights page explain when that applies and what we will do to recover the money.
When money is available. Most transfers are available within minutes, but the date we disclose is the date we commit to. Some transfers take longer because of compliance reviews, holidays, or the recipient's bank or wallet. We will never tell you a transfer is "instant" unless it is.
6. Paying for transfers
You may fund a transfer only with:
- a checking or savings account at a U.S. financial institution that is in your name, by electronic (ACH) debit; or
- a debit card issued in the United States in your name, where card funding is available.
We do not accept cash, money orders, cashier's checks, traveler's checks, credit cards or reloadable prepaid cards. Speedy does not hold a stored balance for you. Each transfer is paid for when you send it.
Bank debit authorization. When you pay from a bank account, you authorize us and our Partner to debit that account for the total shown in the pre-payment disclosure, and, if a transfer is cancelled or refunded, to credit it. If the debit is returned or reversed, we may cancel the transfer if it has not been paid out, and you agree to repay any amount paid out to your recipient that we could not collect, plus any fee your bank charged us that the law allows us to pass on.
Taxes. Because we accept only electronic funding, transfers through Speedy are not currently subject to the federal remittance transfer excise tax that applies to cash-funded transfers. Any tax we collect will always be shown before you pay.
7. Limits, reviews and holds
We and our Partner set daily, monthly and per-transfer limits, which you can see in the app. Limits depend on how much we have verified about you and on our risk policies. We may change them at any time.
We may delay, hold, refuse or reverse a transfer if we reasonably believe it is needed to comply with law (including sanctions and anti-money-laundering rules), to prevent fraud or harm to you or others, or because the information provided is incomplete or inaccurate. If a review means the money may not be available by the date we disclosed, we will tell you before you pay wherever possible. A delay after payment does not reduce your rights under Section 9.
8. Cancelling a transfer
You can cancel a transfer for a full refund, including fees and any taxes we collected, if you ask within 30 minutes of paying and the money has not yet been picked up or deposited into your recipient's account. Cancel in the app, or contact us using the details on your receipt. We refund within three business days of your request. Recurring transfers have their own cancellation rule in Section 11.
9. Errors and problems with a transfer
Federal law gives you the right to dispute errors in a remittance transfer. You must contact us within 180 days of the date of availability on your receipt. We will investigate, determine whether an error occurred within 90 days, and report the results to you within three business days of finishing. If there was an error, you may choose a refund or, in many cases, to have the money resent at no extra cost. The full explanation, including what counts as an error, is on the Remittance Transfer Rights page.
You can report a problem in the app, by phone at support phone, by email at support@speedymoneytransfer.com, or by message to our WhatsApp assistant, which passes it to a person and gives you a reference number. The date we first receive your report is the date of your notice.
10. Sending by link
Where available, you can send money by link. You enter the amount, the country and the name of the person you expect to receive it, and we give you a link and a one-time code to share with that person yourself. Your recipient opens the link, enters the code and gives their payout details. Speedy checks those details where it can and then shows them to you in full. You must review and confirm them before you approve the transfer, and before you pay we will warn you that incorrect account details could mean losing the money. Money moves only after you approve and pay. Links expire after seven days, and five incorrect codes lock a link. Links are limited to $500 per transfer, or a lower limit if one applies to you.
11. Recurring transfers
Where available, you can schedule transfers to repeat. For the first transfer we give you the full pre-payment disclosure and a receipt. For each later transfer we give you a receipt, and if any disclosed amount will change we will tell you before the transfer is made. You can cancel any scheduled transfer by telling us at least three business days before its scheduled date. When a recurring transfer debits your bank account, you authorize those debits under the terms you accept when you set up the schedule, and you can revoke that authorization the same way.
12. Using WhatsApp and chat
You can message Speedy on WhatsApp for help. Where available, you can also send to recipients you have paid before, approving each transfer with your passkey or PIN within the limits shown in the app. All disclosures and receipts apply as they do in the app. Messages are also covered by our Messaging Terms, and the assistant by our AI Assistant Terms. Meta Platforms, Inc. operates WhatsApp; its own terms and privacy policy apply to your use of WhatsApp.
13. Fees
Our fees and the way we set exchange rates are described on the Fees and Exchange Rates page. The fee and exchange rate for a transfer are those shown in its pre-payment disclosure. We will not charge fees that are not disclosed to you.
14. Refunds
When we refund a transfer, we return the money to the account or card you paid with, unless the law requires otherwise or we agree another method with you. Refunds for cancellations are made within three business days of your request; refunds for errors follow the timelines on the Remittance Transfer Rights page.
15. What you must not do
You must not use the Services for anything illegal, fraudulent or harmful, or for any activity listed in our Acceptable Use Policy, including sending money for someone else, to evade sanctions, or in connection with illegal gambling or scams.
16. Suspending or closing your account
You can close your account at any time in the app or by contacting us. We may suspend, restrict or close your account, or refuse a transfer, if you break this Agreement, if we must do so by law or by order of a regulator, if we reasonably suspect fraud, sanctions violations or other illegal activity, or if continuing would expose you, us or others to harm. We will tell you when we do this unless the law prohibits it or it would compromise security. Closing an account does not affect transfers already paid for, your rights relating to them, or records we must keep by law.
17. Communications and electronic records
We provide disclosures, receipts and notices electronically under our E-Sign Consent. We may contact you by email, in-app notice, text message or WhatsApp as described in our Messaging Terms.
18. Your privacy
Our Privacy Notice explains how we collect, use and protect your information, including information about your recipients and how our AI assistant handles messages.
19. Intellectual property
Speedy, the Doctor Bird logo and all content and software in the Services belong to Speedy or its licensors. We give you a limited, personal, non-transferable and revocable license to use the Services as this Agreement allows. You may not copy, modify, reverse-engineer or resell any part of them. If you send us feedback, we may use it without obligation to you.
20. Disclaimers
Except as stated in this Agreement or required by law, the Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free. Nothing in this section limits our obligations for transfers you have paid for, including those under the Electronic Fund Transfer Act and Regulation E.
21. Limitation of liability and indemnity
To the fullest extent the law allows, Speedy will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Services. For claims that are not about a remittance transfer, our total liability is limited to the greater of $100 or the fees you paid us in the 12 months before the claim.
These limits do not apply to, and nothing in this Agreement waives or reduces: (a) your rights under the Electronic Fund Transfer Act, Regulation E or any other law that cannot be waived; (b) our obligation to refund or resend a transfer as the law requires; or (c) liability for our fraud, gross negligence or willful misconduct.
You agree to reimburse Speedy for losses caused by your fraud or your intentional breach of this Agreement, to the extent the law allows.
22. Resolving disputes, arbitration and class action waiver
Talk to us first. Before starting a claim, send a written description of your dispute and what you want to complaints@speedymoneytransfer.com or to our address above. We will try in good faith to resolve it within 30 days. Our Complaints Policy explains the process. This does not delay your rights to report an error within 180 days or to contact a regulator.
Agreement to arbitrate. If we can't resolve a dispute, you and Speedy agree to resolve any claim arising from this Agreement or the Services by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitrator decides all questions about the scope and enforceability of this section, except that a court decides questions about the class action waiver and the mass-arbitration procedure. Speedy will pay all AAA filing, administration and arbitrator fees for claims you bring, unless the arbitrator finds your claim frivolous. Hearings may be held by video or in the county where you live.
Exceptions. Either of us may bring an individual claim in small claims court. Either of us may seek a court order to stop misuse of intellectual property. Nothing here prevents you from reporting to or contacting any government agency, including the CFPB or a state regulator.
No class actions. You and Speedy may bring claims only individually, not as a plaintiff or class member in any class, collective or representative action. The arbitrator may award relief only in favor of the individual party seeking it. If a court decides you are entitled to public injunctive relief, that claim will be decided by a court after the individual arbitration ends.
Mass arbitration. If 25 or more similar claims are filed by the same or coordinated counsel, the claims will be administered in batches of 25, with one arbitrator per batch, and fees will be assessed per batch. Statutes of limitation are paused while claims wait in the queue.
Jury waiver. If a claim proceeds in court, you and Speedy waive any right to a jury trial.
Your right to opt out. You can reject this arbitration agreement by emailing legal@speedymoneytransfer.com with your name, account email and a statement that you opt out, within 30 days of first accepting this Agreement. Opting out does not affect any other part of this Agreement.
Changes to this section. If we change this section, the change will not apply to a claim that arose before the change, and you may reject the change by opting out within 30 days of notice.
Governing law and courts. This Agreement is governed by federal law and the laws of the State of Florida, without regard to conflict-of-law rules. Any court claim permitted by this Agreement will be brought in the state or federal courts for Walton County, Florida, unless the law gives you the right to sue where you live.
23. Changes to this Agreement
We may change this Agreement. For changes that reduce your rights or increase your costs, we will notify you at least 30 days before they take effect, unless a faster change is required by law or to prevent fraud. Changes do not apply to transfers paid for before they take effect. If you don't agree, you may close your account before the change takes effect. Each version is listed with its effective date at the top of this page.
24. Translations
This Agreement may be available in Spanish, French and Haitian Creole. If a translated version of this Agreement conflicts with the English version, the English version controls, except that disclosures, receipts and notices required by law are provided accurately in each language we offer, and you may rely on the version in your language.
25. General terms
- Entire agreement. This Agreement and the documents it includes are the entire agreement about the Services.
- Assignment. You may not transfer this Agreement. We may transfer it to an affiliate or successor, or as part of a merger or sale, with notice to you.
- Severability. If any part is unenforceable, the rest remains in effect.
- No waiver. If we don't enforce a term, we may still enforce it later.
- Events beyond our control. We are not responsible for delays caused by events beyond our reasonable control, except where the law makes us responsible for a remittance transfer.
- Survival. Sections that by their nature should survive closure of your account, including 9, 14, 19 to 22 and 25, survive.
